These Terms of Service ("Terms") govern your access to and use of the Clever Tour website and the features we offer—including browsing tours and vacation products, creating an account, using the cart and placing orders, payments, viewing orders, using Clever Assistant for recommendations, submitting reviews, and sending feedback. If you use the site on behalf of an organization, you represent that you have authority to bind that organization. Certain features may have additional rules; if those rules conflict with these Terms, the additional rules control for that feature.
Clever Tour is an online travel information and booking platform. We display tours, vacation products, and related details, and provide account, order, and technical capabilities—including payment flows hosted by providers such as Stripe—and ways to contact support. The actual travel or ground services are usually delivered by the supplier, agent, or partner for each product; dates, meeting points, inclusions and exclusions, cancellation terms, and similar items are as shown on the product page, your order confirmation, and any notices you receive. Card networks, banks, and payment processors may apply their own terms; you agree to comply with those where relevant.
Some features require an account. You agree to provide accurate information and keep your login credentials secure. You are responsible for activity under your account except where caused by our failure to provide reasonable security. You must not impersonate others, misuse another person’s account, or interfere with the security or normal operation of the site. We may suspend or terminate accounts or access where we reasonably suspect fraud, abuse, or breach of these Terms.
Prices, tax wording, promo or coupon rules, and options such as party size or room types are as shown at checkout; review your order summary carefully. Prices may change due to exchange rates, supplier updates, tax rules, or errors; where a clear pricing error has occurred and performance has not reasonably begun, we may work with you to adjust or cancel the order as permitted by law and fair practice. Payment is typically completed on secure pages operated by Stripe or similar processors; we will not ask you for complete card data outside those flows. A binding contract is generally formed when payment succeeds or as otherwise stated on the order; follow your order status and confirmation messages for details.
You may request cancellation or refunds through the order or product screens when available. Refund percentages, time windows, and fees can vary by product line, agent policy, or how close the departure date is—always follow the rules shown for that booking on the site (examples may include fuller refunds farther ahead of departure and reduced or no refunds very close to departure). If a trip is changed or cannot operate due to force majeure, supplier issues, or safety concerns, we will try to notify you via order updates or email and handle next steps under applicable law and product rules.
Clever Assistant and similar tools help you explore products and add suggestions to your cart. Outputs are generated by models and site content and may be incomplete, outdated, or unsuitable for your needs. They are not legal, medical, visa, insurance, or safety advice; please verify important decisions using official sources, product pages, and your own judgement.
Where allowed, you may post reviews reflecting genuine experience. You keep rights in text or images you submit (such as copyright where applicable) and grant us a license to use that content to operate, display, and improve the service. You must not post unlawful, infringing, false, abusive, or junk‑marketing material; we may remove or restrict clearly violating content where appropriate.
You agree not to: overload the site with scraping or aggressive automation without permission; attempt unauthorized access to systems, data, or other users’ accounts; distribute malware; or use the site for fraud, money laundering, or other illegal activity. You also agree not to circumvent technical limits to copy large portions of the site for competing or harmful purposes. We may use technical and legal means to stop such conduct and seek remedies for harm caused.
The site’s design, branding, layout, compilations, and other protected materials belong to us or our licensors. You may not copy, modify, or distribute them for commercial purposes without permission, except as allowed by applicable copyright or other laws.
To the fullest extent permitted by law, the service is provided "as is" and "as available." Short outages may occur due to maintenance, upgrades, network issues, or third‑party failures; we will work to restore service but are not liable for indirect, incidental, or punitive damages arising from use of the site. We are responsible for losses only where required by law or expressly stated in these Terms. We are not responsible for issues caused by your breach, inaccurate information you supply, or force majeure and third‑party services beyond our control. Some jurisdictions do not allow certain disclaimers or liability caps; in those places, these limits may not apply to you.
These Terms are interpreted under the laws that apply between you and Clever Tour. Disputes should first be discussed in good faith; if unresolved, either party may pursue remedies in courts or arbitration as required by applicable law.
We may update these Terms or related policies. Material changes will be announced on the site or by other reasonable means. Continued use after the effective date means you accept the updated Terms.
